    INTRODUCTION

    Digital data has seen remarkable growth in the current era with many people storing the data in electronic form in massive amounts to enable the data to be easily retrieved when needed, as well as to carry out routine activities by using emails, messaging texts and Facebook posts. This type of data will be printed and tendered as digital evidence in the Courts. Due to the potential fragility of digital evidence, the discipline is rooted in the basic collection and preservation process handled by the crime scene investigators and their team. The digital evidence will only be admissible if the chain of custody is established, without tampering, during the movement of such evidence from the crime scene to the courtroom. So, amongst all these steps, first and foremost is the manner of dealing with digital evidence in the search and seizure process which is paramount and pertinent in determining its authenticity in subsequent disputes on its admissibility.

    When the Residential Tenancies Act 1997 (the Act) came into force, one of its initiatives was to introduce the concept of "conditional termination and possession orders" (CTPOs). The idea behind CTPOs was that if a tenant breached a tenancy by failing to pay rent when it was due, instead of the Tribunal immediately terminating the tenancy, the Tribunal could make an order requiring the tenant to catch up on rent over time. If the tenant failed to comply with the order in the future, the tenancy would immediately terminate and the lessor could recover possession.

    CTPOs were seen as giving a tenant a ‘last chance’ to mend their ways and comply with their tenancy agreement or face being evicted. While CTPOs were available to both public and private lessors, they were mostly availed of by the Commissioner for Social Housing.

    ABSTRACT

    The bail system is a very important part of any criminal justice system. Any poor handling of the system is bound to be calamitous. For long, bail in Nigeria has been regarded as a mere part of the arraignment stage in criminal litigation and not as a system with clear objectives. The aim of this study is to review the system of bail administration in Nigeria and propose an alternative system. The author finds that the current system of bail is under performing. This paper adopts the doctrinal research methodology and explores the objectives of bail in Nigeria. He finds that the system is affected by the lack of a clear statement of the objectives of bail and it identifies the faults in the recent Administration of Criminal Justice Act as it relates to the bail system. The work concludes that the current system hinged on this Act is inept to deal with the challenges of the system. It recommends the enactment of a Nigerian Bail Act clearly stating the objectives of the system, creating a pre-trial service agency and creating a National Bail commission to oversee the operations of Bonds Men and formulate Bail Policies and Regulations. He also recommends the granting of license to Bonds Men, and the adequate use of data and research.

    MENTAL HEALTH LAW DEVELOPMENT IN MALAYSIA

    Abstract

    This study aims to trace the development of mental health laws in Malaysia since the early 1900s. This will include legislations and policy namely the Lunatic Ordinance of Sabah 1951, Mental Disorders Ordinance 1952, Mental Health Ordinance of Sarawak 1961, Mental Health Act 2001 and National Mental Health Policy 1997. This study reveals that Malaysian mental health laws have undergone major developments throughout the years. The current Mental Health Act 2001 is more comprehensive, as compared to the previous Ordinances, in addressing several issues such as applicability of the law throughout Malaysia, delivery of health services and the rights of mentally disordered persons. Furthermore, this study analyses several international legal instruments involving mental healthcare and the rights of mentally disordered persons which Malaysia adhered to. It is found that Malaysia has manifested its commitment under the international legal instruments through local legislations such as Mental Health Act 2001 and Persons with Disabilities Act 2008. In addition, the rights of mentally disordered persons are also guaranteed under the Malaysian Federal Constitution.
