[1] Issue: Whether in a case where the accused had pleaded guilty to three distinct counts of robbery, the learned Sessions Court judge was right in principle in refusing to consider the accused’s guilty plea as a mitigating factor and in imposing a sentence of 39 years’ jail and 15 strokes of the rotan on the accused.

“The learned Sessions Court Judge refused to consider the plea of guilt as a mitigating factor and to me rightly so as the offence committed was a serious offence.”

“The court when considering the plea of guilt should not lose sight of the broader principles of sentencing which includes taking into account the nature of the offence. The learned Sessions Judge was right in considering the offence of robbery to be a serious offence. More so in this case where the accused committed the three robberies on three consecutive days, and armed with dangerous weapons.”

“I could not fault the learned Sessions Judge for imposing a consecutive total sentence of 39 years for all the three charges. Even taking into account the totality principle, 39 years is not manifestly excessive. The accused also deserved the 15 strokes of the rotan imposed for the 3 offences” – per Akhtar Tahir J in Jailani Saleh v. PP [2013] 1 LNS 167.

ENTOMOLOGI FORENSIK (FORENSIC ENTOMOLOGY) DAN
PERANANNYA DALAM PENYIASATAN KES JENAYAH DI MALAYSIA

Pengenalan

Entomologi forensik (forensic entomology) bukanlah sesuatu yang baru. Ia adalah salah satu cabang sains forensik tertua yang digunakan dalam penyiasatan kematian. Ia pertama kali dicatatkan dalam kesusasteraan pada tahun 1235 Masihi, dalam sebuah teks Cina, satu manual latihan tentang menyiasat kematian berjudul The Washing of Wrongs (diterjemahkan oleh McKnight). Kerja ini mendokumenkan penggunaan terawal keterangan entomologi yang diketahui dalam penyiasatan jenayah. Secara khususnya, Penyiasat Kematian Cina, Sung Tzu (Chinese Death Investigator, Sung Tzu) telah menyiasat pembunuhan seorang pekerja petani yang mayatnya ditemui di sawah padi. Menyedari kekurangan bukti fizikal di tempat kejadian dan mempunyai sedikit keterangan dengan mempersoalkan orang kampung, Tzu meminta agar setiap petani di kampung membawa sabit mereka kepadanya untuk pemeriksaan. Beliau mengatur sabit-sabit mereka bersama-sama dan mendapati bahawa selepas beberapa minit, lalat berkumpul pada hanya satu sabit iaitu sabit yang mempunyai jumlah kesan darah dan cebisan mikroskopik tisu pada bilah. Dengan pemerhatian ini, pemilik sabit tersebut mengambil petanda sebagai amaran agama, dan dengan sertamerta mengaku salah terhadap pembunuhan tersebut.[1]

Mayat manusia, sama ada mereka telah dihasilkan secara semula jadi atau akibat perbuatan manusia, diproses oleh pengurai serangga dengan cara yang sama seperti mana-mana bangkai lain. Oleh itu, analisis spesimen forensik entomologi adalah berdasarkan kajian serangga yang berada dalam mayat untuk proses penguraian dan pada kadar yang mana pelbagai peringkat perkembangan serangga tersebut. Pengetahuan tentang pengedaran, biologi dan tingkah laku serangga ini, yang makanan kepada mayat, boleh membantu penyiasatan forensik dengan menyediakan maklumat mengenai bila, di mana dan bagaimana seseorang itu mati atau jenayah telah dilakukan.[2]

CIVILIAN AND DEMOCRATIC DIMENSIONS OF GOVERNANCE IN ISLAM*

Classical Islamic political thought contains ideas and principles comparable to modern day tenets of democracy and pluralism. Islamic thought is derived mainly from the guidelines of the Qur’an and Sunnah on consultation, equality, justice, human dignity and so forth, which bear substantive harmony with the principles of democracy and human rights. Modern writers have further developed the democratic substance of these guidelines and have to some extent adjusted the medievalist overtones of the earlier interpretations. We submit that Islamic political order remains open to development and reform without negating its own religious and ideological heritage. The Islamic polity also historically embraced within its fold many religious and ethnic communities and lived the reality, as it were, of a civilian approach to society and politics. It is this theme that our discussion in the following pages seeks to develop. I propose, however, to start the discussion with an introductory section on Islam and secularism as this is the principal tool and engagement of the western conceptions of democracy and constitutionalism. We need to ascertain the extent of its relevance to Islamic governance.

I. Islam and Secularism

The question we pose and address here is over the relevance of the secularist debate to Islam. Secularism (Arabic: 'alaminiyyah, or dunyawiyyah) means that which is worldly and temporal, and it is usually taken to imply the liberation of politics from religion. It came to the Muslim world together with its related concepts such as modernity and westernization in the context of colonialism. For the Muslim world, secularism has largely meant the marginalisation of Islam and its exclusion from reconstructing society during both the colonial and post-colonial periods.
