May it please Your Lordships, Chief Justice of the Federal Court, President of the Court of Appeal, Chief Judge of Malaya and Chief Judge of Sabah and Sarawak, Minister in the Prime Minister’s Department, Puan Hajah Nancy Shukri, Judges of the Superior Courts and Judicial Commissioners, State Attorney General of Sabah and State Attorney General of Sarawak, Chairman of the Bar Council and Presidents of the Sabah Law Association and the Advocates’ Association of Sarawak, Distinguished Members of the Bar and honoured guests, Colleagues of the Judicial and Legal Service, Ladies and gentlemen.

INTRODUCTION

My Lords, ladies and gentlemen,

On behalf of the Attorney General’s Chambers, I record my deepest appreciation to the Honourable Chief Justice of the Federal Court, YAA Tun Arifin bin Zakaria, for the renewed honour of addressing this fifth Opening of the Legal Year. On this ceremonial occasion, it is perhaps timely to recall the origins of this event in the Middle Ages in the United Kingdom. For the legal fraternity, this traditional gathering commemorates the principles of defending access to justice and the rule of law. Furthermore, as emphasized in a recent article in the UK Law Society’s newsletter, such events “... reminds all of those actively involved within the legal system of the need to uphold these principles internationally, as well as at home, for the benefit of society.”

ARBITRATION CLAUSE AND EXCLUSIVE JURISDICTION CLAUSE
– A CASE FOR CONFLICT OR HARMONY?

1. Abstract

Arbitration is a blooming alternative dispute resolution mechanism. Arbitration, unlike courts, are empowered only by parties’ agreement. However, what is a little strange is that some agreements incorporated both an arbitration clause to submit their disputes to arbitration and an exclusive jurisdiction clause conferring jurisdiction on the court of a particular jurisdiction.

Initially it was thought that these clauses were conflicting with each other, thereby rendering the possibility that one of the clauses can be ineffective. However, over time it was interestingly learned that the two clauses are not in conflict with each other but they are in harmony with each other. The rationale behind this school of thought is that the parties have bound themselves to arbitration, and the arbitration is subject to the exclusive supervisory jurisdiction of the court designated by the exclusive jurisdiction clause. This article aims to analyse the relationship between the two clauses.
