1. Signing of letter of offer

The letter of offer will set out the salient terms of the sale and purchase of the property (the details of the property, the parties and the purchase price).

2. Signing of sale and purchase agreement ("SPA")

It will be provided in the letter of offer how soon from the date of the letter of offer the SPA is required to be executed by the parties. This period is to enable parties to negotiate on the other terms and conditions of the SPA not set out in the letter of offer.

HANDLING VIRTUAL DAMAGE CAUSED BY MALWARE AND BADWARE: SHOULD COMPUTER INFORMATION AND DATA BE TREATED AS 'PROPERTY'?

Abstract

As more users store valuable data and information online and experience damage and loss to such data and information due to malware and badware attacks, reliance on the Malaysian Computer Crimes Act alone does not seem ideal to handle the problem. The article discusses the possibility of treating computer information and data as property under the Malaysian Penal Code so that the problem concerning virtual damage caused by malware and badware can be properly addressed. Comparative overviews of other legislation are made to add value to the discussion.

Background

The employment of malware and badware in causing virtual damage, popularly termed cyber vandalism,[1] can happen in many ways. For example, a hacker can create computer programs embedded with viruses ready for execution under the guise of innocent computer programs. He or she can also disseminate malware by embedding it in email attachments, employ a browser hijacker to enable auto download of vandals the moment a particular webpage is opened, use a rootkit[2] to get into a computer and modify its contents, or work his or her way towards causing a denial of service attack.

First and foremost may I take this opportunity to thank the Dean and the academic staffs of Pusat Pengajian Undang-Undang, Kolej Undang-Undang, Kerajaan dan Pengajian Antarabangsa, Universiti Utara Malaysia and the Law Students Society, Universiti Utara Malaysia for inviting me to deliver a lecture on the occasion of this Asian Law Students Association (ALSA) National Conference 2014.

Ladies and Gentlemen,
