IN THIS ARTICLE, DINESH SADHWANI EXAMINES WHEN AN ANNOUNCEMENT OF MATERIAL INFORMATION BY A LISTED ISSUER SHOULD BE MADE UNDER THE MAIN MARKET LISTING REQUIREMENTS ("MMLR") OF BURSA MALAYSIA SECURITIES BERHAD ("BURSA").

Paragraph 9.02(1) of the MMLR of Bursa provides that a listed issuer must disclose to the public all material information necessary for informed investing and take reasonable steps to ensure that all who invest in its securities enjoy equal access to such information.

PRINSIP SIASATAN DAN PENDAKWAAN JENAYAH SYARIAH: SATU PENJELASAN BERASASKAN AL QURAN DAN AL SUNNAH

Abstrak

Tidak dinafikan bahawa sebahagian besar prosedur berkaitan siasatan dan pendakwaan kes jenayah syariah yang wujud pada hari ini telah diambil daripada Kanun Tatacara Jenayah dan Akta Keterangan 1950. Walau bagaimanapun ada di kalangan kita yang beranggapan bahawa kedua-dua prosedur tersebut tidak mempunyai asas langsung dalam al Quran dan al Sunnah. Sangkaan dan tuduhan sedemikian adalah tidak benar sama sekali serta mengelirukan. Penulisan ini menjawab tuduhan tersebut. Ianya menegaskan bahawa setiap peruntukan berkaitan prosedur siasatan dan pendakwaan kes jenayah syariah yang ada pada hari ini sebenarnya mempunyai prinsip asas yang kukuh dalam al Quran dan al Sunnah. Penulisan ini turut menegaskan kepentingan untuk memperbetulkan sebarang persepsi yang salah berkaitan isu tahap pembuktian serta kebolehterimaan qarinah dalam kes-kes jenayah syariah termasuk hudud dan qisas.

Kata kunci: Prinsip siasatan jenayah syariah, prinsip pendakwaan jenayah syariah, prosedur siasatan, prosedur pendakwaan, prinsip syariah.

Abstract

Undeniably, most of the investigation and prosecution procedures in syariah criminal cases today have been taken from the Criminal Procedure Code and the Evidence Act 1950. Nevertheless some of us perceive that both procedures have no basis at all in the Quran and the Sunnah. Such perception and accusation are indeed false and confusing. This writing answers this accusation. It emphasizes that every provision regarding investigation and prosecution procedures has a firm basis in the Quran and the Sunnah. This writing also emphasizes the importance of correcting any form of false perceptions in issues pertaining to quantum of proof and admissibility of qarinah in syariah criminal cases including hudud and qisas.

First and foremost may I take this opportunity to thank the Dean and the academic staffs of Pusat Pengajian Undang-Undang, Kolej Undang-Undang, Kerajaan dan Pengajian Antarabangsa, Universiti Utara Malaysia and the Law Students Society, Universiti Utara Malaysia for inviting me to deliver a lecture on the occasion of this Asian Law Students Association (ALSA) National Conference 2014.

Ladies and Gentlemen,

I would like to put on record here that the invitation to deliver a lecture at this conference was first extended to the Right Honourable Chief Justice, Tun Arifin bin Zakaria.
