ANTI-SUIT INJUNCTION IN ENFORCEMENT OF ARBITRATION AGREEMENT AND EXLCUSIVE JURISDICTION AGREEMENT

1. Introduction

An anti-suit injunction is a preventive injunction made against a party in personam[1] restraining the party from instituting certain legal action[2] or from proceeding with a legal action already instituted.[3] Anti-suit injunction can be an alternative remedy to stay of proceedings in favour of an arbitration agreement. Such anti-suit injunction is particularly useful when the stay is not available or when it is especially difficult to get the stay. It is a remedy to be considered commonly when the court proceedings are instituted or threatened to be instituted in a foreign court.

While the stay of proceedings in local courts are highly statutorily regulated and generally made mandatory by virtue of section 10 of the Arbitration Act 2005, there is no specific legislation with respect to anti-suit injunctions in favour of an arbitration agreement. However, there are general statutory provisions[4] coupled with equitable principles and case law guiding the grant of anti-suit injunctions. It is of interest here to analyse how this branch of the law developed along with the worldwide development of policy in favour of arbitration. At the outset, there has been no specific change in the legislation in this area, and perhaps such legislative change is neither required nor appropriate. Rather the law on this area should be, and has been, developed through case law.

JENAYAH MORAL DAN KESUSILAAN DI BAWAH UNDANG-UNDANG JENAYAH SYARIAH MALAYSIA: PEMBUKTIAN KES MELALUI QARINAH RAKAMAN FOTO DAN VIDEO DIGITAL*

PENGENALAN

Jenayah Moral dan Kesusilaan mempunyai konotasi yang amat luas sebenarnya di sisi Undang-Undang Jenayah Syariah di negara ini. Ianya meliputi pelbagai perlakuan jenayah syariah berat yang dianggap melanggar nilai-nilai moral dan kesusilaan menurut syariah seperti persetubuhan luar nikah atau zina, perbuatan sumbang mahram dan perbuatan melacurkan diri serta segala perlakuan lain yang mempunyai hubungkait secara langsung dengannya. Dalam masa yang sama, jenayah moral turut meliputi perlakuan-perlakuan jenayah syariah lain seperti liwat dan musahaqah. Skop jenayah moral seterusnya terbukti luas apabila ianya turut sama meliputi perlakuan-perlakuan jenayah syariah lain seperti persediaan melakukan persetubuhan di luar pernikahan, khalwat, perilaku lelaki berlagak seperti wanita serta jenayah berkelakuan sumbang di tempat awam. Kesemua jenis perlakuan jenayah moral dan kesusilaan di atas dianggap sebagai kesalahan jenayah syariah kerana kesemua perlakuan-perlakuan tersebut menyalahi serta melanggari batas-batas moral dan kesusilaan di sisi prinsip syariah.

Setiap negeri di Malaysia mempunyai enakmen-enakmen jenayah syariah masing-masing yang turut menyelitkan peruntukan undang-undang syariah mengenai pelbagai kesalahan jenayah syariah yang menyalahi batas-batas moral dan kesusilaan. Akta Kesalahan Jenayah Syariah (Wilayah-Wilayah Persekutuan) 1997 umpamanya ada menggariskan beberapa bentuk kesalahan jenayah moral dan kesusilaan yang dianggap paling berat dan serius. Seksyen-seksyen tersebut adalah seksyen 23 (persetubuhan luar nikah) seksyen 20 (perbuatan sumbang mahram) serta seksyen 21 (pelacuran). Kedua-duanya seksyen 23 (1) dan seksyen 23 (2) memperkatakan tentang jenayah melakukan persetubuhan di luar pernikahan yang sah di antara lelaki dan perempuan secara sukarela antara kedua-duanya. Seksyen 23 (1) berbunyi:
