TIMBANG TARA DALAM INDUSTRI PEMBINAAN BAGI KONTRAK PEMBINAAN BANGUNAN KERAJAAN*

PENGENALAN

Dalam pelaksanaan projek pembinaan bangunan kerajaan atau badan berkanun, salah satu perkara yang sering terjadi adalah pertikaian di antara pihak-pihak yang terlibat, terutamanya di antara klien (jabatan atau agensi kerajaan) dengan kontraktor, sama ada mengenai bayaran, pelan dan lukisan, tempoh masa pelaksanaan kerja, kualiti dan kuantiti kerja (Barnett, 1997; Harrison, 2004; Talal Abi-Karam, 2001). Pertikaian perlu diselesaikan demi menjamin pelaksanaan lancar projek pembinaan dan demi kebaikan pihak-pihak yang terlibat. Dengan itu diwujudkan beberapa kaedah penyelesaian: Mesyuarat tapak, Arahan Pegawai Penguasa, Perantara, Timbang tara, dan Mahkamah. Namun begitu alternatif perantara tidak ada disediakan di dalam Borang Perjanjian Seragam Jabatan Kerja Raya (JKR)(Borang Seragam JKR 203) yang digunakan dalam projek pembinaan bangunan kerajaan. Didapati banyak pertikaian diselesaikan semasa mesyuarat tapak. Jika tidak dapat diselesaikan, kontraktor akan menunggu arahan Pegawai Penguasa (P.P). Jika kontraktor masih tidak berpuashati keputusan P.P., biasanya dia membawa terus ke mahkamah. Amat jarang kontraktor dan juga kerajaan cuba merujuk kepada timbang tara (Kuala Lumpur Regional Center for Arbitration)(KLRA, 2004), walaupun "Rujukan Kepada Timbang tara" ada diperuntukkan di bawah "fasal timbang tara" (fasal 54, Borang Seragam JKR 203/203A)(Lim Chong Fong, 2004).
