HUKUMAN BUNUH TERHADAP TINDAKAN MURTAD DALAM PERSPEKTIF MASYARAKAT MAJMUK DAN KEAMANAN NEGARA

ABSTRACT

Kes-kes murtad yang berlaku di Malaysia mengejutkan sebahagian besar umat Islam. Demi memelihara agama, terdapat desakan agar hukuman bunuh dilaksanakan terhadap orang yang murtad. Dengan itu, beberapa rang undang-undang menetapkan bahawa murtad hendaklah dihukum bunuh. Namun begitu, hukuman bunuh terhadap murtad boleh mengeruhkan suasana hubungan masyarakat pelbagai kaum dan agama. Oleh itu, kefahaman terhadap hukuman bunuh dalam riwayat hadis sewajarnya difahami dalam konteks kenegaraan. Hukuman bunuh terhadap murtad tidaklah termasuk dalam kategori hudud sebaliknya diletakkan dalam kategori takzir. Dengan memahami riwayat hadis ini dalam konteks ini, maka hukuman bunuh terhadap murtad bukanlah kerana murtad, namun kerana penghinaan terhadap Islam yang wujud selepas dari murtad. Maka murtad yang menghina Islam sewajibnya dihukum. Ini kerana penghinaan terhadap Islam merosakkan asas penting dalam Perlembagaan yang menyatakan bahawa Islam adalah agama Persekutuan.

PENDAHULUAN

Isu murtad adalah isu yang besar di Malaysia. Justeru itu, masyarakat Islam di Malaysia mengambil perhatian yang besar terhadap tindakan murtad. Oleh itu, terdapat gesaan agar undang-undang murtad dilaksanakan. Perlaksanaan undang-undang murtad yang dimaksudkan ialah hukuman bunuh.
