INTRODUCTION

IN THIS ARTICLE, SHARON CHIEN COMPARES AND HIGHLIGHTS THE CHANGES IN THE TRADE DESCRIPTIONS ACT 2011 WHICH REPLACED THE TRADE DESCRIPTIONS ACT 1972.

The Trade Descriptions Act 2011 ("TDA 2011") governs the quasicriminal nature of prosecution that rights holders can rely on to curb counterfeiters. This mechanism works hand in hand with the Ministry of Domestic Trade, Cooperatives and Consumerism ("MDTCC") which will then use its statutory powers to enforce the rights of the trade mark owners.
