DEVELOPMENT OF PUBLIC POLICY TOWARDS ARBITRATION

It is well known today that arbitration is a popular and significant alternative dispute resolution mechanism and is well recognised. International treaties have emerged in promotion of arbitration[1] and local legislations in many parts of the world have followed in promotion of arbitration and enforcement of arbitration agreements.[2]

At this point, it is interesting to note that it was once thought that an arbitration agreement restricted a party’s freedom to enforce his rights by the usual legal proceedings, and accordingly it was against public policy[3] and invalid for that reason.[4]

In Kill v. Hollister (1746),[5] an arbitration clause in an insurance policy was held to be ineffective so that the insured could successfully institute action in a court of law without reference to arbitration. Similarly in Thompson v. Charnock (1799),[6] an arbitration clause in a charterparty was held to be ineffective with the result that the aggrieved party was able to have the dispute resolved by the court of law without reference to arbitration.[7]
