[1] Issue: Whether r. 137 of the Rules of the Federal Court 1995 permitted an appeal from the Court of Appeal to the Federal Court in a matter that commenced in the Sessions Court:

"As I have stated in Cheng Bee Teik & Ors v. Peter Selvaraj & Anor [2005] 2 CLJ 839 and Noraini Omar & Anor v. Rohani Said & Another Appeal [2006] 1 CLJ 895 that, as far as fatal accident and personal injury claims arising from motor vehicle accidents are concerned, the Court of Appeal stands as the apex court, as such no further appeal shall lie to this court. (See s. 67(1) and s. 96(a) of the Courts of Judicature Act 1964.) That is the intention of the legislature and it is incumbent upon this court to give effect to it. When the law states that the decision of the Court of Appeal is final, then the appeal process should stop at the Court of Appeal; it cannot be allowed to come to this court by way of a review process under r. 137 of the Rules of the Federal Court 1995." – per Arifin Zakaria FCJ in Abdul Ghaffar Md Amin v. THE GROWING NEEDS OF MAINTENANCE OF CHILDREN ABOVE 18 YEARS IN THE ERA OF INFORMATION TECHNOLOGY: AN ANALYSIS OF THE FAMILY LAWS IN MALAYSIA*

INTRODUCTION

In the early 80s, there has been no reported case on the issue of maintenance of children who attained the age of 18 years or exceeded the age. However, recently over the years due to the aspiration of the nation towards a k-economy, there has been increasing debate on the issue of the responsibility of parents to maintain their children. There are around 300,000 upper-secondary school graduates per year in Malaysia and about 68% of these students pass the national exam, Sijil Pelajaran Malaysia (SPM). Only around 30% (60,000) of the passing students get to continue their education in secondary schools due to limited spaces.[1] The balance of 70% (144,000) has the alternative of going to government polytechnics and vocational education and skill training institutions or private institutions with significantly higher tuition fees.[2] Higher learning initiatives by school leavers are expected to continue to grow in the future due to Malaysia's pursuit of a k-economy and aspiration to reach a developed nation status by year 2020. Therefore, the following discussion focuses on the law relating to the maintenance of children who have attained the age of 18 years or above.

Prior to the enactment of the Money Services Business Act 2011 (“MSBA”), the money-changing industry in Malaysia was regulated by the Money-Changing Act 1998 and the Exchange Control Act 1953 while the payment remittance industry in Malaysia was regulated by the Payment Systems Act 2003 and the Exchange Control Act 1953. In addition, wholesale currency business was previously regulated by the Exchange Control Act 1953.
