PP v. MOHD HATTA MD RAMLI & ORS [2010] 4 CLJ 985

[1] Issue: Whether the Sessions Court Judge was right in discharging not amounting to an acquittal an accused who stood charged for an offence of unlawful assembly under s. 143 of the Penal Code on the ground that the charge, for charging less than five accused persons, failed to meet the definition of "unlawful assembly" in s. 141 of the Code, and was hence groundless and defective.

"It is my finding that the said charges are good in law and the learned Sessions Court Judge had erred in law and in fact when he decided that the said charges were groundless. It is my view that it is unnecessary for a charge under s. 143 of the Penal Code to consists of five or more persons or to state the presence of other person unknown or unidentified to make up the minimum requirement of five persons including the accused."

"By analogy, in a rape case, penetration is one of the ingredients for an offence of rape but it is sufficient to state in the charge that the accused had committed rape without alluding to the act of penetration though it constitutes one of the elements of rape. On the same premise, a charge for unlawful assembly could not be said as groundless simply by a reason that it does not state the existence of five persons or more. It is a matter for the prosecution to prove during the trial that five or more persons including the accused were involved in the alleged assembly so as to make it 'unlawful' as defined under s. 141 of the Penal Code and punishable under s. 143 of the Code ..." – per Azman Abdullah JC in PP v. Mohd Hatta Md Ramli & Ors [2010] 4 CLJ 985.

CONSTITUTIONAL ARRANGEMENTS ON RELIGION AND RELIGIOUS FREEDOM IN MALAYSIA AND INDONESIA: FURTHERING OR INHIBITING RIGHTS?*

In societies where group identities - be they ethnic, religious, linguistic or regional - are socially and politically salient, states face major challenges in balancing conflicting intergroup rights and interests and maintaining public order. That such identities are also overlapping in Malaysia and Indonesia may complicate matters further, especially when fundamental rights questions are implicated. This paper examines the theoretical and practical aspects of the constitutionalization of religion and religious freedom in the two countries. I question, in particular, the extent to which constitutional guarantees and arrangements can act as a rallying point for different groups in a divided society and protect the rights promised on paper. To that end, I begin by analyzing provisions on religion and religious freedom and the debates and considerations that led to the drafting of those provisions. I then examine how courts have interpreted and applied the provisions in two controversial cases that have surfaced in Malaysia and Indonesia. I argue that carefully-crafted constitutional provisions have been applied to favor majority opinions and sentiments. This has put into the inability of minority religious adherents to freely practice and express their religion in the two countries under study. More worryingly, these outcomes have deepened religious cleavages and exacerbated tensions and intolerance.

ABSTRAK

Di era globalisasi pembentukan dan amalan undang-undang antarabangsa telah disejagatkan dengan berpaksikan Barat. Adalah menjadi tanggungjawab setiap Muslim untuk bangun menyanggah gelombang tersebut dengan mempelopori satu pendekatan undang-undang antarabangsa yang boleh diterima umum dan yang benar-benar sejagat. Masyarakat Islam perlu mengambil pendekatan sebegini dalam memahami undang-undang, nilai dan etika, dan memulakan satu kerjasama menyeluruh dalam membangunkan siyar, yang akan membantu mereka memelihara kepentingan antarabangsa mereka dan menyumbang kepada kebajikan dunia amnya.

ABSTRACT

In the globalization era, the development and practice of international law have essentially become Western centric. What is demanded of the Muslims today is to oppose that dominant approach and instead propose an alternative approach which is commonly acceptable and truly universal. Muslims in particular, have to pursue this approach of common understanding of law, values, and ethics and initiate a broad based Islamic cooperation in the development of siyar, which will facilitate the accomplishment of their global interest and consequently contribute to the general welfare of the world.

ABSTRAK

Hukuman mati mandatori seperti yang diperuntukkan ke atas kesalahan mengedar dadah dan memiliki senjata api adalah di antara hukuman yang agak kontroversi dan mendapat kecaman daripada masyarakat antarabangsa sejak kebelakangan ini. Beberapa kajian yang dijalankan mendapati hukuman mati lebih berkesan dalam membendung berbagai gejala jenayah yang semakin menular dalam masyarakat. Penulis akan mengupas berkenaan peruntukan hukuman mandatori dan hukuman mati mandatori di Malaysia ke atas kesalahan-kesalahan tertentu, kedudukan hukuman mandatori dan peruntukan mati mandatori menurut perspektif Shariah.

ABSTRACT

Capital punishment as imposed on the drug trafficking and possessing firearms crimes in Malaysia has received a lot of criticism from international community. Researches show that to some extent, capital punishment can deter proliferation of serious crimes. This paper will discuss the provision of death penalty for some serious offences in Malaysia, the concept of mandatory and mandatory capital punishment from Shariah viewpoint.
