Bila kes dikembalikan semula ke Mahkamah Majistret, OKS, walau bagaimanapun, telah mengaku bersalah dan mahkamah menetapkan hukuman denda sebanyak RM1,500 jika gagal bayar penjara satu bulan.

FIRDAUS AZIZ ABDULLAH v. PP [2013] 9 CLJ 886
[3] Issue: On the workings of s. 53(1) Arms Act 1960 and the power of Magistrates and Sessions Court Judges to seize, forfeit or release arms as the case may be under the section (herein, shotgun and firearm license).
“The proviso to s. 53(1) of the Arms Act 1960 gives the Sessions Court Judge or Magistrate the power to order the release of any seized arms and/or ammunition to the person named in that order. He/she “may” order such release, regardless of whether any person has been convicted of the offence which led to the arms and/or ammunition being seized in the first place. The person named in the order need not be the person from whom the arms and/or ammunition were seized. The fact that no one, including the appellant, was ever charged with any offence in relation to the shotgun was not material for the purpose of the exercise by the Sessions Court Judge or Magistrate of his/her power to order (or not to order) the release of the shotgun to the appellant on the appellant’s application. Section 53 is however silent as to what matters need to be taken into consideration by the Sessions Court Judge or Magistrate in making a decision whether to release or not to release any arms/ammunition to any person. It is also silent as to the procedure to be followed by the Sessions Court Judge or Magistrate in the making of such decision.”
“The learned Sessions Court Judge and the learned Judicial Commissioner had taken into account the circumstances in which the shotgun was obtained by the appellant and, more importantly, the circumstances in which the replacement and subsequent renewals of the licence for the shotgun were applied for and made. The learned Sessions Court Judge found those circumstances were such that they gave rise to suspicion that the shotgun was obtained by “dubious and surreptitious means”. The learned Judicial Commissioner agreed ... In the circumstances as discussed by both the learned Sessions Court Judge and the learned Judicial Commissioner in their respective grounds of judgment and our findings above, we are unanimous in our view that the learned Sessions Court Judge did not err in dismissing the appellant’s application for the release of the shotgun to him, and consequently the learned Judicial Commissioner did not err in confirming that decision.” – Per Zaharah Ibrahim JCA upon delivering the judgment of the Court of Appeal in Firdaus Aziz Abdullah v.
