HAKCIPTA DALAM KARYA YANG BERTENTANGAN DENGAN POLISI AWAM

Pengenalan

Hakcipta memberi perlindungan kepada sesuatu karya yang menepati syarat yang termaktub dalam Akta Hakcipta 1987 tanpa mengambilkira kualiti ataupun tujuan karya-karya itu dihasilkan.[1] Suatu karya mendapat perlindungan hakcipta secara automatik sekiranya memenuhi syarat-syarat yang digariskan. Karya tersebut hendaklah merupakan dari kategori karya yang layak mendapat perlindungan hakcipta sebagaimana yang diperuntukkan oleh undang-undang,[2] ianya bersifat asli, sesuatu karya dalam format bentuk bahan dan penciptanya adalah orang yang berkelayakan.[3] Justeru, semua jenis karya yang menepati syarat-syarat ini secara umumnya berhakcipta tanpa mengambilkira tujuan atau kesan yang mungkin diperolehi menerusi penghasilan karya tersebut. Tiada terdapat undang-undang bertulis yang jelas menyatakan bahawa karya yang mengandungi unsur-unsur yang menyinggung kesantunan, memudaratkan keselamatan awam atau dalam erti kata lain bertentangan dengan polisi awam tidak berhak untuk mendapat perlindungan hakcipta. Polisi awam boleh didefinisikan sebagai sistem undang-undang atau pengukuran sebuah peraturan.[4] Dalam erti kata lain, polisi awam merujuk kepada tindakan kerajaan dalam membuat sesuatu perkara dan ianya akan menjadi garis panduan kepada pihak yang akan melaksanakannya. Ia boleh wujud dalam beberapa bentuk seperti pernyataan lisan oleh kerajaan atau arahan bertulis seperti akta-akta. Bagi sesebuah karya yang bertentangan dengan polisi awam, tidak terdapat perbincangan ilmiah secara menyeluruh mengenai perkara ini di Malaysia.[5] Mahkamah di Malaysia juga tidak pernah membincangkan mengenai sama ada karya yang bertentangan dengan polisi awam ini berhak untuk mendapat perlindungan hakcipta.

THE MALAYSIAN COMPETITION COMMISSION GUIDELINES*

IN THIS ARTICLE, TASHA PRASHEELA CHANDRA CONSIDERS THE GUIDELINES ISSUED BY THE MALAYSIAN COMPETITION COMMISSION ("MYCC"), WHICH ACTS AS A REFERENCE ON HOW THE MYCC INTERPRETS THE COMPETITION ACT 2010.

The Malaysian Competition Act 2010 ("the Act") came into force on 1 January 2012. The Guidelines were subsequently issued in May and July 2012. The Guidelines, which will be discussed in more detail below, provide insight as to how the MyCC interprets the Competition Act 2010.[1]

The MyCC has issued four Guidelines:

° Guidelines on Market Definition

° Guidelines on Anti-Competitive Agreement

° Guidelines on Abuse of Dominant Position, and

° Guidelines on Complaints Procedures.

The Guidelines on IP rights and Franchise Agreements will be issued later.

THE LEGAL GOVERNANCE ON THE EMPLOYMENT OF FOREIGN WORKERS IN MALAYSIA

ABSTRACT

Whether or not to engage foreign workers is the conundrum on Malaysian authorities' minds when the subject of foreign workers come to the forefront of discussions. Most Malaysians are unwilling to work in the industries that attract a lot of foreign workers who earn minimum wages that have been set, as such foreign workers is a must have for such industries to survive. With such an influx of foreign workers, this has inevitable impacted Malaysia be it from a legal, economic or social perspective. In this paper, the authors have taken the liberty to analyse all relevant legislative provisions to determine their efficacy in the regulation of foreign workers in Malaysia. The authors have also listed out the current Standard Operating Procedures (SOP's) for the employment of foreign workers, the rights and responsibilities of the workers as well as the employers, the analysis of Health and Safety regulations and any other pertinent issues that have arisen in the course of writing up this paper. This paper is envisaged to benefit all those connected to the foreign workers market either directly or indirectly by providing the latest information pertaining to this area with a view that more relevant laws and regulations be correctly implemented to further regulate the foreign workers industry in Malaysia.
