PP v. MARWAN ISMAIL [2008] 3 CLJ 164

[1] Issue: On the true purport of s. 41A Dangerous Drugs Act 1952 ('DDA') - and what a Magistrate needs to do in a case where an accused person who is tentatively charged for drug trafficking under s. 39B(1) DDA is brought up before him for a mention:

"Section 41A DDA is a special provision under a special law which operates independently of any other provisions. It provides for a convenient procedure whereby one who is charged with a capital offence under the DDA which is triable only by the High Court may be produced before "the appropriate court" (note that it need not be a Magistrate's Court) in order to obtain an order for transmission. Once produced, that court is under a mandatory obligation to order a transmission of the case."

"If an accused person charged for an offence under s. 39B(1) DDA is produced before a Magistrate, the Magistrate must do the following:

(i) Have the charge read to him.

(ii) Explain to him the charge.

(iii) Not to record any plea by the accused, even if he chose to make one.

(iv) Transmit the case to the High Court.

(v) Cause the accused person to be brought before the High Court as soon as is practicable."

"It may be noted that the reference to the preliminary inquiry in the section is now superfluous since Chapter XVII of the Criminal Procedure Code has been repealed." - per Abdull Hamid Embong JCA in PP v. Marwan Ismail [2008] 3 CLJ 164.

WHERE THERE’S A WILL, THERE’S NOT ALWAYS A WAY...*

In a recent decision of the Supreme Court of the ACT (Omari and Omari v. Omari [2012] ACTSC 33), Master Harper illustrated that where a testator lacks capacity at the time of making a will, the outcomes for beneficiaries under that will are anything but certain.

The case

The matter of Omari and Omari v. Omari came before the Master as a result of a caveat lodged by Fatma Omari, the deceased’s daughter, against any grant of probate to the deceased’s sons who were named as executors. Fatma alleged that her mother was suffering dementia when she made her will and that it did not reflect her mother’s wishes. The deceased’s sons applied to set-aside the caveat lodged by Fatma.

THE USE OF SHORT MESSAGE SERVICE (SMS): A NATIONAL AND GLOBAL CONCERN OR A PRIVILEGE*

INTRODUCTION

In the span of few short years, the popularity of Short Message Service (SMS) (hereinafter referred to in the acronym as "SMS") is rising fast in Malaysia as well as around the world. Statistics revealed that for the year 2005, an astounding figure of 4.5 billion messages had been sent by the end of September.[1] It is getting more popular in the United Kingdom. In year 2001, it was reported that over 12 billion of text messages were sent in the United Kingdom. As such, SMS is now a sector which is soon to become the largest form of wireless communication, far outstripping email and snail mail.[2] Undeniably, it has made a significant impact on the development of mobile phone services. Although it is limited in data length, the SMS has grown to be well acceptable by all walks of life.
