Times have been difficult in your conveyancing practice so you are ecstatic when you receive a sales advice from a local agent, especially as the vendor - Harry (for whom you are to act) - is a new client. You contact Harry to confirm instructions, prepare the contract and arrange for him to call to sign.

The property is a shop in the suburbs so you ask if Harry is registered for GST. Harry answers no, saying that he hasn't had the building very long and that it has yet to be rented.

Harry is employed as a carpenter for a local building company and bought the building in a run down state with a view to doing it up in his spare time and making a tidy profit. Which he has. The building purchase, plus renovation costs amounted to approximately $250,000 against the sale price of $500,000.

You therefore tick the appropriate box on the contract to show it is not a taxable supply. Contracts are duly exchanged, the transaction settled, your fees are paid and everyone is happy.

Apakah yang dimaksudkan dengan kata-kata "hak asasi manusia"? Saya tidak akan mencuba memberi takrifannya. Sebaliknya, saya akan merujuk kepada Universal Declaration of Human Rights (UDHR) yang diluluskan oleh United Nations General Assembly pada 10 Disember 1948. Sebagai perbandingan saya akan merujuk kapada The Cairo Declaration on Human Rights in Islam ("Deklarasi Kaherah") yang diterima pakai (adopted) dan dikeluarkan oleh anggota-anggota Organisation of the Islamic Conference (OIC) di Persidangan Kesembilan Belas Menteri-Menteri Luar Negara-Negara Islam di Kahirah pada 5 Ogos 1990. Saya akan merujuk kepada ASEAN Human Rights Declaration (Deklarasi ASEAN). Selepas itu saya akan melihat peruntukan-peruntukan Perlembagaan Persekutuan mengenai hak asasi manusia. Kemudian, saya akan cuba bincang mengenai peranan dan kesan peruntukan-peruntukan itu kepada undang-undang negara dan kedudukan hak asasi manusia khususnya di Malaysia.

THE LEGAL GOVERNANCE ON THE EMPLOYMENT OF FOREIGN WORKERS IN MALAYSIA

ABSTRACT

Whether or not to engage foreign workers is the conundrum on Malaysian authorities' minds when the subject of foreign workers come to the forefront of discussions. Most Malaysians are unwilling to work in the industries that attract a lot of foreign workers who earn minimum wages that have been set, as such foreign workers is a must have for such industries to survive. With such an influx of foreign workers, this has inevitable impacted Malaysia be it from a legal, economic or social perspective. In this paper, the authors have taken the liberty to analyse all relevant legislative provisions to determine their efficacy in the regulation of foreign workers in Malaysia. The authors have also listed out the current Standard Operating Procedures (SOP's) for the employment of foreign workers, the rights and responsibilities of the workers as well as the employers, the analysis of Health and Safety regulations and any other pertinent issues that have arisen in the course of writing up this paper. This paper is envisaged to benefit all those connected to the foreign workers market either directly or indirectly by providing the latest information pertaining to this area with a view that more relevant laws and regulations be correctly implemented to further regulate the foreign workers industry in Malaysia.
