[5] Issue: Whether a Magistrate's/Sessions Court has jurisdiction to make an order of detention for purposes of removal of non-citizen persons from Malaysia:

Legend: The Sessions Court has declined the said detention order for the purpose of effecting the removal of a Myanmar national for reason that under s. 51(5)(b) of the Immigration Act 1959 the court has no power to do so.

"In the case of a detention order required by an Immigration Officer, the Magistrate shall make the detention order for the purpose of (i) investigations into an offence against the Act, or (ii) making inquiries, or (iii) effecting the removal of the subject from Malaysia under the Act. The jurisdiction to make an order of detention for the purpose of effecting the removal of a subject from Malaysia under the Act is there for all to see. Indeed, upon application to a Magistrate, it is incumbent upon him, for the word "shall" is directory, to make the s. 51(5)(b) order". per Jeffrey Tan J in Re Lang Za Thong; ex p Jabatan Imigresen Malaysia [2009] 1 CLJ 108.

The ACT Civil and Administrative Tribunal recently made a finding of unsatisfactory professional conduct against a local lawyer arising out of discourteous, offensive and provocative conduct towards a third party service provider, and a breach of the ethical duty to act courteously in respect of dealings with third parties. The practitioner was publicly reprimanded and ordered to pay the Society’s legal costs.

In February 2011 the practitioner engaged in telephone and email communications with the manager of a third party service provider whilst acting for a client in a conveyance. The content of the practitioner’s emailed communications became the focus of the Law Society’s disciplinary action against the practitioner.

The relevant facts are that following a telephone discussion between the practitioner and manager, the manager sent an email to the practitioner which stated in part:

A CONSTITUTIONAL ENVIRONMENTAL PROTECTION FOR MALAYSIA:
SOME POSSIBILITIES

I. Introduction

“Malaysia, truly Asia”

This catch phrase has long been utilised to market Malaysia to the rest of the world. Whether it was intended to demonstrate the diverse wonders of the land or to emphasise the overlapping cultures that have interwoven into its fabric of life; it has always been, rather symbolically, a demonstration of the reality that exists in Malaysia. Whether one speaks of culinary subjects or legal ones, similar jargons are utilised; melting pot, overlapping and multi-faceted layers, or simply, diversity.

Environmental issues in Malaysia share these similar characteristics.

Present environmental concerns encompass amongst others, issues on “deforestation, pollution of inland and marine waters, soil and coastal erosion, overfishing and coral reef destruction, along with air pollution, water pollution and the problem of waste disposal.[1]
