PENDAHULUAN

Menurut Dawson & Cowan dalam bukunya Religion Online, internet telah mengubah bentuk dan penampilan semua agama di dunia.[1] Hakikat ini turut berlaku kepada agama Islam apabila teknologi internet telah dimanfaatkan sebaiknya. Hal ini secara langsung mengubah cara orang Islam menerima dan mendapatkan maklumat. Sungguhpun internet bukan merupakan guru yang berkesan dan dalam masa yang sama ia merupakan tempat lambakan kepada maklumat, namun ia boleh membantu kita mendapatkan maklumat secara pantas khususnya yang berkaitan dengan Islam. Hal ini boleh membantu menyebarkan agama Islam itu dan boleh untuk menjadi penjana minda masyarakat.

Keadaan ini telah menarik minat aliran Salafi untuk menjadikan internet sebagai medium untuk mereka menyebarkan pemikiran mereka. Apabila diteliti perkembangan ini di seluruh dunia, kita mendapati bahawa aliran ini mempunyai jaringan kekuatan dalam dunia siber. Mereka mempunyai laman web dalam bahasa Arab, Inggeris, Indonesia dan Malaysia. Ke semua mereka atas nama Salafi membawa matlamat perjuangan yang sama iaitu mengembalikan kemurnian ajaran Islam berdasarkan kepada al-Quran dan al-Hadis. Walau bagaimanapun, terdapat kepelbagaian fokus dan pendekatan yang mereka gunakan antara satu sama lain.

FEELING VULNERABLE OR WITHOUT A CARE?*

The NSW Court of Appeal has found that commercial strata schemes are owed a duty of care by builders

Solicitors acting for owners corporations in building defect disputes once made a practice of pleading both negligence and breach of statutory warranties in claims against builders.

That practice was called into question last year by two decisions of the Supreme Court of NSW handed down by McDougall J,[1] where owners corporations had brought two unrelated claims against Brookfield Multiplex. In those cases, His Honour held that builders did not owe a duty of care to residential strata schemes and commercial strata schemes, thereby removing a key avenue of recourse used by owners corporations in claims against builders.

In September 2013, the NSW Court of Appeal overturned the latter of those decisions on several grounds.[2]

Both the reasoning and the decision itself is particularly relevant for the Australian Capital Territory.

CUTTING THE CHAINS OF CO-PROPRIETORSHIPS IN LAND

Under the National Land Code 1965 ('NLC'), a 'co-proprietorship' means the holding of alienated land by two or more persons or bodies in undivided shares and in their own right otherwise than as trustees or representatives.[1]

Since land is held on an undivided share basis, a co-proprietor, in the absence of an agreement with other co-proprietors, cannot simply determine for himself which area on this co-owned land he is entitled to. Many enterprising but ignorant individuals who pool resources to buy land together (or individuals in forced situations like succession to estates) get caught in the intricacies of a co-proprietorship. While some escape by mutual agreement to partition the land, not all are lucky enough to as the factors affecting some lands render them difficult for partitioning.

Even one co-proprietor may have differences in thinking with another, let alone with many others. If one wants to sell but the others don't, conflicts are bound to occur between co-proprietors. In any event, it will not be fair to force the co-proprietors who do not see eye to eye to be perpetually locked in the co-proprietorship. To this end, the court is empowered to terminate the co-proprietorship.
