PP v. SHAHRULNIZAM OTHMAN & ORS [2011] 5 CLJ 674

[2] Issue: (i) Whether a Magistrate may allow a deponent who is not a witness in the trial but whose deposition has been taken under s. 40A of the Immigration Act 1959/63 (`the Act') to be cross-examined by the accused; and (ii) whether there is a lacuna in s. 40A of the Act:

"There is no lacuna in s. 40A of the Act as it is quite clear that the words "Notwithstanding anything contained in this Act and any written law to the contrary" explicitly excludes any other written laws that is the Evidence Act 1950 and the Rules of High Court 1980 in the application of s. 40A. If Parliament had intended that any other provisions in any other written law to the contrary applies to s. 40A of the Act, then it would have clearly stated so as it did in s. 52(4) of the Anti-Trafficking in Persons Act 2007 where Parliament had intended that in the course of the recording of evidence of the trafficked person, he shall be examined in accordance with the provisions of the Evidence Act 1950."

"The learned Magistrate was wrong in adopting the approach which she had adopted in allowing the learned counsel for the respondents the right to cross-examine the deponent. The upshot is that the decision of the learned Magistrate made on 25 May 2010 is set aside and further order that the proceeding be held without the right by counsel to cross-examine the deponent." - Per Sofian Abd Razak J in PP v. Shahrulnizam Othman & Ors [2011] 5 CLJ 674.

The increasingly common practice of ‘trial by media’ is not a new phenomenon, either in Australia or internationally.

More often than not, trial by media is associated with allegations of major criminality - on the international stage, think OJ Simpson, the disappearance of Madeleine McCann, and the ignoble antics of the former managing director of the IMF, Dominic Strauss-Kahn.

Closer to home, consider the Chamberlains, spare some sympathy for a sad and damaged Schapelle Corby, and vale Joe Korps.

Take a walk in the shoes of media - hounded, strip-searched, and arrested federal MP, Craig Thompson, and reflect on the plight of hapless ‘sex monster’ Adrian Bayley - the already publicly condemned alleged murderer of Jill Meagher, the Irish ABC Radio employee who was killed in Melbourne in September 2012. Bayley has already spent most of his life behind bars, and is likely to languish there for what’s left of it.

FOCUSING EXPERT EVIDENCE AND CONTROLLING COSTS

1. INTRODUCTION

1.1 The text of this lecture is being distributed at the start of this seminar. The paragraphs of this lecture are numbered for ease of reference on future occasions (such as the forthcoming lecture on case management).[2]

1.2 Terms of reference. It will be recalled that my terms of reference for the Civil Litigation Costs Review included a requirement to:

“Establish the effect case management procedures have on costs and consider whether changes in process and/or procedure could bring about more proportionate costs.”

1.3 Role in implementation . I have subsequently been asked to take a proactive role[3] in relation to the implementation of the Costs Review recommendations, following their endorsement by the Judicial Executive Board and their broad acceptance by the Government. This role includes (a) assisting with the drafting of rule amendments and (b) helping to explain the forthcoming reforms to court users. Hence the present lecture.
