LIAW TZE LOONG v. PP [2013] 1 LNS 603
[3] Issue: Whether the learned Magistrate, in slightly amending the charge under s. 11(b) of the Anti-Corruption Act 1997 by deleting the words “and you” therein, committed a fatal breach of s. 158(i) of the Criminal Procedure Code, when he failed to read and explain the amended charge to the accused.
“Section 158(i) provides that any court may alter or add to any charge at any time before judgment is pronounced and s. 158(ii) provided that every alteration or addition shall be read and explained to the accused. It was decided in Hee Nyuk Fook v. PP [1988] 1 LNS 15; [1988] 2 MLJ 360 that the question whether s. 158(ii) CPC is mandatory or directory depends on the facts and circumstances of a particular case including the nature of the amendment, whether it is purely technical, whether it is in any way substantial to render the omission to read over and explain the amended charge a serious irregularity as to vitiate the proceeding or occasion a failure of justice or whether it is curable under s. 422 CPC. No hard and fast rule can be laid down merely from the use of the word “shall” therein.”
“From the facts and circumstances of the case, the amendment to the charge against the appellant was minor. The record of appeal showed that the appellant understood and was not confused or misled by the amended charge. He was able to make his defence and was not prejudiced by the amendment or the omission to read and explain the amended charge to him. At all material times he was represented by an experienced counsel. In this case, the omission to read and explain the amendment to the charge did not occasion a failure of justice.” – per Stephen Chung J in Liaw Tze Loong v. PP [2013] 1 LNS 603.
