IN THIS ARTICLE, LILIEN WONG LIEN LIEN ANALYSES THE CASES DECIDED BY THE MALAYSIAN COMPETITION COMMISSION AND DISCUSSES HOW THE COMING INTO FORCE OF THE COMPETITION ACT 2010 AFFECTS THE WAY BUSINESSES ARE CONDUCTED IN MALAYSIA.

Introduction

The Malaysian Competition Commission or more commonly known as the MyCC was set up as an independent body to enforce the Malaysian Competition Act 2010 ("Act") that came into force on 1 January 2012. The Act has a wide coverage as most, if not all, enterprises (save where specific exemptions under the Act apply) that carry out any commercial activities which may have an impact on competition in the market fall under the scrutiny of the MyCC.

The MyCC is seeking to reform the way businesses are conducted in Malaysia. The first Malaysian Competition Law Conference held on 25 and 26 September 2013 carried the theme "Competition Act 2010 Compliance Guidelines" ("Compliance Guidelines") which set out how to implement a competition law compliance programme for enterprises.

Who is at fault when clients fail to do something which they are asked to do?

A few recent claims have arisen because a client has failed to do something which the practitioner has asked them to do, even though it was necessary for the successful progression of the client's matter.

One might expect that any loss incurred as a result would be the client's fault, and a claim against the practitioner would not be successful. However, that is not the case when there is a deadline involved and the client was not informed about the deadline and the consequences of failing to meet it (or the client was informed, but the practitioner cannot prove they were informed).

For example in a property purchase matter, the practitioner sent the client a stamp duty concession form for completion and return. The client believed that the stamp duty wasn't payable for several months so took a few months to complete and return the form. It appeared from the file that he hadn't been informed that the concession documents had to be lodged within 90 days of exchange. The failure to inform the client, and/or chase the client for return of the form to lodge it on time, would probably result in a successful claim against the practitioner for the loss incurred.
