THE RULE OF LAW
COMMENCEMENT OF THE 2015 LEGAL YEAR*

I welcome all practitioners to the first opening of the law year held in the Supreme Court - and (we hope) the last to be held in this courtroom.

2014 was challenging for all of us. It was my first full year as Chief Justice. I recognise that both the profession and the government worked closely with the Court to implement change.

But the challenges that we faced in the ACT paled in comparison to those faced by our sister state. 2014 ended tragically with the Lindt Cafe siege which struck at the heart of Sydney's legal precinct and resulted in the death of two victims, one of whom was a fellow barrister, and a week of chaos in the courts. Many of us were only one or two degrees removed from that tragedy. Our sons and daughters frequented the Lindt Cafe, our friends shared chambers with the victim.

Then the New Year brought the Charlie Hebdo massacre and the "Je suis Charlie" phenomenon.

ISSUES IN THE MALAYSIAN STATUTORY HOUSING AGREEMENTS (SCHEDULES G, H, I AND J): 'DEFECT LIABILITY PERIOD'

Abstract

Defect liability period clause is provided in the statutory housing agreements - Schedules G, H, I and J ('the said agreements'). However, this liability is not provided if the housing project is abandoned. Thus, in the event of housing abandonment, the purchasers may not be able to get protection under defect liability period clause. Due to this lacuna, the rights of purchasers may be undermined. This paper aims to highlight this issue - defect liability period in the said agreements, particularly involving abandoned housing projects in Malaysia. This research paper used a pure legal research methodology. This paper finds that due to the absence of specific clause of defect liability period in the said agreements in the event of housing abandonment, the rights of the purchasers will be denied and they will suffer irreparable damage. At the ending part of this paper, the author suggests some recommendations to settle the issues identified.

MATRIMONIAL PROPERTY DIVISION OF MARRIED COUPLES IN MALAYSIA

Introduction

When a marriage relationship breaks down, the married couple may divide their properties in the divorce application. Generally, properties would be divided into matrimonial property and separate property. The statutes in Malaysia are silent on the definition of 'matrimonial property'. Generally, the term 'matrimonial property' describes the property acquired during the subsistence of marriage.[1] In the case of Ching Seng Woah @ Cheng Song Huat v. Lim Shook Lin (F),[2] Shankar J refers 'matrimonial property' to:

... the expressions refer to the matrimonial home and everything which is put into it by either spouse with the intention that their home and chattels should be a continuing resource for the spouses and their children to be used jointly and severally for the benefit of the family as a whole. It matters not in this context whether the asset is acquired solely by the one party or the other or by their joint efforts. Whilst the marriage subsists, these assets are matrimonial assets. Such assets could be capital assets. The earning power of each spouse is also an asset.
