Open justice lies at the heart of the Australian court system. The principle has been variously described as 'immutable',[2] an 'essential aspect' of judicial character[3] and 'the best security for the pure, impartial and efficient administration of justice'.[4]

Unsurprisingly, the concept has a variety of meanings. At base, it requires that court proceedings and associated documents be physically accessible to the general public. Yet perhaps more importantly, especially as most people rarely, if ever, are inclined to attend court as spectators,[5] open justice entails media access to courtroom hearings so that such reporting can be disseminated to a larger audience.

The Wellness Network for Law is a community of Australian legal academics, practitioners and students.[1] It aims to address the high levels of psychological distress experienced in the practise of law, and to promote wellness at law school, in the legal academy, and in the legal profession. The Network held its annual forum at ANU on 5-6 February 2015.[2] This article outlines some of the forum highlights that may be of particular interest to legal practitioners and managers of law practices.[3]

MATRIMONIAL PROPERTY DIVISION OF MARRIED COUPLES IN MALAYSIA

Introduction

When a marriage relationship breaks down, the married couple may divide their properties in the divorce application. Generally, properties would be divided into matrimonial property and separate property. The statutes in Malaysia are silent on the definition of 'matrimonial property'. Generally, the term 'matrimonial property' describes the property acquired during the subsistence of marriage.[1] In the case of Ching Seng Woah @ Cheng Song Huat v. Lim Shook Lin (F),[2] Shankar J refers 'matrimonial property' to:

... the expressions refer to the matrimonial home and everything which is put into it by either spouse with the intention that their home and chattels should be a continuing resource for the spouses and their children to be used jointly and severally for the benefit of the family as a whole. It matters not in this context whether the asset is acquired solely by the one party or the other or by their joint efforts. Whilst the marriage subsists, these assets are matrimonial assets. Such assets could be capital assets. The earning power of each spouse is also an asset.
