[1] Issue: Whether it is legally proper for the Sessions Court judge to compel or force a litigant’s representative who was present in court to testify on the ground that the latter’s evidence is relevant to the issue in dispute.

“Finally I am perturbed that the learned Sessions Court judge had agreed to the oral application to force DW2 (who is a representative of the defendant (insurer) and happened to be present in court) to testify. Litigation in this country is premised on an advocacy system which means that litigants are in control of their respective case and that means that it is their absolute right to decide what witness to call or not to call to support their respective case. It is not the duty of the court to force litigant to supply witness whom it thinks is relevant to the issue in dispute. The court’s primary duty is (to) deliberate on evidence tendered by the litigant. If one party fails to call a relevant witness, the court is entitled to invoke s. 114 of the Evidence Act which allows the court to draw (an) adverse inference for that failure.” – per David Wong Dak Wah J in Tokio Marine Insurans (Malaysia) Bhd v. IN THIS ARTICLE, IRENE YONG YOKE NGOR REVIEWS THE CURRENT CASE OF WINCOR NIXDORF (M) SDN BHD V. MINISTER OF FINANCE AND DIRECTOR GENERAL OF CUSTOMS AND EXCISE[1] RELATING TO THE NOVEL ISSUE FOR CUSTOMS DUTIES AND SALES TAX PURPOSES, AND WHETHER A MINISTERIAL DISCRETION IS SUBJECT TO JUDICIAL REVIEW PROCEEDINGS.

Facts

Wincor Nixdorf (M) Sdn Bhd (“WN”) carried on the business of distributing automated teller machines (“ATMs”) and other products and solutions and had engaged certain freight forwarders to handle the importation of the ATMs and parts into Malaysia. However, without WN’s knowledge or authorisation, the forwarders had engaged other forwarders (“unauthorised forwarders”) to clear the goods through the Customs Department (“Customs”).

Upon suspicion of commission of fraud or other wrongdoing (“Fraud”) by the unauthorised forwarders, Customs commenced investigations in 2007 into the operations of the unauthorised forwarders.

ACHIEVING A CULTURE CHANGE IN CASE MANAGEMENT

1. INTRODUCTION

1.1 The text of this lecture is being distributed at the start of this seminar. The paragraphs of this lecture are numbered for ease of reference during the discussion which will follow my presentation.

1.2 Terms of reference . It will be recalled that my terms of reference for the Costs Review included a requirement to:

“Establish the effect case management procedures have on costs and consider whether changes in process and/or procedure could bring about more proportionate costs.”

1.3 Role in implementation . I have subsequently been asked to take a proactive role[2] in relation to the implementation of the recommendations made in the Costs Review Final Report (“the Final Report”),[3] following their endorsement by the Judicial Executive Board and their broad acceptance by the Government. This role includes (a) assisting with the drafting of rule amendments and (b) helping to explain the forthcoming reforms to court users. Hence this lecture and the present seminar, which is being very kindly hosted by the Judicial Institute at UCL.
