ABSTRACT

The task of regulating hate speech is especially challenging today due to the heightened awareness of human rights. People focus more on their right to free speech than on exercising responsibility; resulting in an increase in derogatory and racist remarks. The damaging consequences of hate speech on the victim and society as a whole are well known. Despite this, hate speech laws remain controversial in many countries due to the perceived conflict with free speech. This is why it is pertinent to deliberate on whether free speech is really a right above all others, or are there justifiable reasons for restricting speech. In doing so, the paper will discuss the influence of hate speech on racist and discriminatory ideologies, briefly highlighting the position of hate speech in international law and then elaborating on the purpose of legislation. Lastly, the paper provides examples of racial and religious animosity as a result of hate speech. It is hoped that by considering the many problems brought about by hate speech, there will be a better appreciation of the need to balance our rights and the need to act responsibly.

DISPUTE AS TO EXISTENCE OF DISPUTE FOR REFERENCE TO ARBITRATION

1. Abstract

When there is an arbitration agreement between the parties, generally they are bound by it to refer disputes between them to arbitration. When a party institutes an action in the court and the other party claims reference to arbitration in light of an arbitration agreement between the parties, it is one of the natural requisites for the reference to arbitration and stay of court proceedings that matters brought to the court concern a dispute between the parties and is one covered within the arbitration clause and is due for reference to arbitration.

However, interestingly, question can arise as to whether there is a dispute between the parties. The further possible questions in the same direction are whether the dispute is within the scope of the arbitration agreement and whether the dispute is due for reference to arbitration. It is the aim of this article to analyse these interesting questions as to dispute for reference to arbitration.

HOW SERIOUS IS TAX EVASION?: AN EMPIRICAL LEGAL ANSWER*

Tax evasion has persistently carried severe penalties, although its intended deterrence effect is highly doubtful. We can safely say that it is based on the widely shared assumption among government officials that tax evasion is among the more serious crimes. In other words, the rationale of the current approach is that the punishment should fit the crime. By taking this into account, this empirical work sets out to expand on previous studies by examining the relative seriousness of 75 crimes and analyzing some demographic variables, including gender, age, marital status, religion and others, to determine whether tax evasion is as serious a crime as some policy makers believe it to be, and to determine whether opinions differ based on demographics. The study finding shows that tax evasion is deemed to be less serious than the average crime. The article concludes that since tax evasion was deemed to be less serious than most other offenses, one might reasonably conclude that the punishment for tax evasion should be less than the punishment for most other offenses.
