IN THIS ARTICLE, NICHOLAS TAN CHOI CHUAN REVIEWS THE CASE OF SEEK KENG LEONG V. BURSA MALAYSIA SECURITIES BHD ON WHETHER BURSA MALAYSIA SECURITIES BERHAD (“BURSA”) HAS THE POWER TO GRANT ORDERS OF RESTORATION.

The powers granted to Bursa in relation to the enforcement of the Main Market Listing Requirements (“Listing Requirements”) are undoubtedly wide ranging. Pursuant to paragraph 16.19 (previously paragraph 16.17), Bursa is empowered to take or impose any of the actions or penalties as stipulated in that paragraph against listed companies and/or its directors or officers for any breach of the Listing Requirements. Some of the actions or penalties that Bursa may take are issuance of a caution letter, issuance of a public reprimand, imposition of a fine not exceeding RM1 million and any other action it deems appropriate.

BEWARE: THE PITFALLS OF REACHING SETTLEMENT*

It is a primary aim of dispute resolution that matters be resolved as quickly and as cost-effectively as possible. The law loves compromise.[1] However, there are numerous pitfalls waiting for those who rush to settle a dispute without fully understanding the ultimate effect, and enforceability, of the terms of settlement.

Understand the issues

Ignorance is not bliss when advising a client on the prospects of making or defending a claim. Lawyers should strive to get a thorough understanding of the material facts of a matter at the earliest opportunity and reliably ascertain what loss a party may have suffered. This is consistent with a lawyer’s obligation to act with competence and diligence.[2]

MATRIMONIAL PROPERTY DIVISION OF MARRIED COUPLES IN MALAYSIA

Introduction

When a marriage relationship breaks down, the married couple may divide their properties in the divorce application. Generally, properties would be divided into matrimonial property and separate property. The statutes in Malaysia are silent on the definition of 'matrimonial property'. Generally, the term 'matrimonial property' describes the property acquired during the subsistence of marriage.[1] In the case of Ching Seng Woah @ Cheng Song Huat v. Lim Shook Lin (F),[2] Shankar J refers 'matrimonial property' to:

... the expressions refer to the matrimonial home and everything which is put into it by either spouse with the intention that their home and chattels should be a continuing resource for the spouses and their children to be used jointly and severally for the benefit of the family as a whole. It matters not in this context whether the asset is acquired solely by the one party or the other or by their joint efforts. Whilst the marriage subsists, these assets are matrimonial assets. Such assets could be capital assets. The earning power of each spouse is also an asset.
