[4] Isu: Berkenaan sama ada hakim Mahkamah Sesyen menggunakan kaedah yang betul apabila meminda pertuduhan terhadap tertuduh dengan hanya menggantikan perkataan-perkataan di dalam pertuduhan asal tanpa membuat apa-apa pertuduhan baru.

“Terdapat perbezaan yang jelas di antara peruntukan s. 158 dan s. 173(h)(ii) Kanun Tatacara Jenayah. Seksyen 158 membenarkan pindaan dibuat dengan mengubah atau menambah sesuatu perkara kepada pertuduhan yang dirangka terhadap seseorang tertuduh. Seksyen 173(h)(ii) pula membolehkan mahkamah meminda pertuduhan bagi kesalahan lain dari yang dipertuduhkan jika kes prima facie terhadap kesalahan lain tersebut telah dibuktikan terhadap tertuduh berasaskan keterangan yang dikemukakan oleh pihak pendakwa.”

“Hakim perbicaraan tidak menjelaskan di bawah peruntukan manakah pindaan pertuduhan dilakukan. Adalah lebih baik sekiranya hakim perbicaraan menjelaskan perkara ini. Apa pun, setelah meneliti keadaan kes ini, peruntukan yang paling sesuai digunakan oleh hakim perbicaraan untuk meminda pertuduhan-pertuduhan terhadap perayu adalah peruntukan s. 158 KTJ.”

“Cara pemindaan pertuduhan yang dilakukan oleh hakim perbicaraan kurang tepat kerana pemindaan dilakukan hanya dengan memadamkan perkataan asal yang terdapat di dalam pertuduhan dan menggantikannya dengan perkataan baru. MAINTAINING THE CURRENCY OF YOUR PRACTISING CERTIFICATE

Recently an ACT practitioner of almost 16 years standing lost the right to hold an unrestricted practising certificate (‘UPC’).

In 2010 another practitioner’s certificate was cancelled despite having an uneventful conduct history.

Also in 2010 yet another practitioner’s certificate was immediately suspended because he had not notified the Law Society of a show-cause event, the significance of which called into question his right to continue to hold an unrestricted practicing certificate.

In each example the practitioner’s fitness and propriety to hold a practicing certificate underwent intense scrutiny by the Council of the Law Society.

Every year the Law Society receives applications from practitioners for the grant or renewal of practising certificates. In almost all instances the Society is satisfied that the applicant is a fit and proper person to hold or continue to hold a certificate to practice.

It has been more than five years since her husband died of AIDS, but Che Tom (not her real name) still finds it hard to forgive him and his family for concealing the fact that he was HIV-positive when they got married. Che Tom came down with a severe illness in 2000. A blood test at the Changloon Hospital confirmed that she had the dreaded virus. However, she felt very relief to know that her two girls were not infected.[1]

INTRODUCTION

The number of women infected with HIV and AIDs is on the rise in Malaysia and Che Tom's case is one of the growing number of women with HIV. Women comprised just 0.9% of those with AIDS in 1994, however this had increased to 7% by 2004 and in June 2005, 4,841 women were diagnosed with HIV and AIDS. An estimated 582 women died of A1DS.[2] (Health Ministry statistic). This figure, according to many in the health field, is not the exact data since many of those infected suffer in silence and succumb to their illness. According to Malaysian's AIDS Council (MAC), president Dr Adeeba Kamarulzaman, the public has always perceived that a majority of the HIV-positive women are sex workers, but studies proved otherwise. Among the women infected whose occupations were known, 1628 were housewives and 406 were sex workers. By the World Health Organisation’s definition, Dr Adeeba mentioned that Malaysia's HIV/AIDS problem is now considered a concentrated epidemic and it is a cause for concern.
