REMEDY AS OF RIGHT FOR CONSUMER PROTECTION

INTRODUCTION

The evolution of globalisation which is characterized by the liberalisation of capital movements, the deregulation of major financial markets and the spread of neo-liberal beliefs in the merits of open and competitive trade have changed the world social economy.[1] The changes in the world social economy have since created various adverse effects and implications on social welfare especially the welfare of consumers. Nowadays, consumers are no longer the major influential group which control the market economy, conversely, they are the weakest parties in consumer transactions. With the market commercial forces, globalisation that promotes economic efficiency, economic growth and commercial gains have forgone ethical trading among traders. Hence, consumer rights are being abused and taken advantage of by unethical traders which results in a lack of bargaining power or no bargaining power at all in consumer transactions. Furthermore, with the advancement of information technology and technology communications, it has not just changed the environment of consumer transactions but also poses potential risks that affects the consumers' right as a whole.

URUSAN YANG WAJAR SEBAGAI SUATU DALIHAN DALAM PERMASALAHAN
HAK CIPTA DAN KEBEBASAN BERSUARA

Pengenalan

Urusan yang wajar atau kegunaan yang wajar[1] berfungsi sebagai suatu dalihan bertitik tolak daripada kes di Amerika Syarikat, Folsom lwn. Marsh[2] di mana menerusi kes ini, undang-undang telah mendefinisikan semula makna pelanggaran hak cipta. Kes ini telah mewujudkan suatu asas yang menekankan bahawa hak cipta merupakan subset kepada undang-undang domain awam dalam bentuk monopoli statut secara terhad. Ia turut mengubah hak cipta menjadi subset kepada undang-undang harta sebagai hak undang-undang semulajadi/natur.[3] Dalam kes ini, penyalinan semula 255 muka surat daripada 6,763 helaian (kira-kira 3.8 peratus) tidak dianggap sebagai sebuah pelanggaran. Di United Kingdom pula, urusan yang wajar mula diperuntukkan menerusi Copyright Act 1911. Manakala urusan yang wajar diperkenalkan oleh undang-undang tempatan menerusi Akta Hak cipta 1987.[4]

Urusan yang wajar bermakna seseorang itu boleh menggunakan sesuatu karya tetapi ada had dari segi penggunaannya.[5] Lord Denning M.R. dalam kes Hubbard lwn. Vosper[6] telah menyatakan bahawa, suatu urusan yang wajar adalah seperti yang berikut:

HOW SERIOUS IS TAX EVASION?: AN EMPIRICAL LEGAL ANSWER*

Tax evasion has persistently carried severe penalties, although its intended deterrence effect is highly doubtful. We can safely say that it is based on the widely shared assumption among government officials that tax evasion is among the more serious crimes. In other words, the rationale of the current approach is that the punishment should fit the crime. By taking this into account, this empirical work sets out to expand on previous studies by examining the relative seriousness of 75 crimes and analyzing some demographic variables, including gender, age, marital status, religion and others, to determine whether tax evasion is as serious a crime as some policy makers believe it to be, and to determine whether opinions differ based on demographics. The study finding shows that tax evasion is deemed to be less serious than the average crime. The article concludes that since tax evasion was deemed to be less serious than most other offenses, one might reasonably conclude that the punishment for tax evasion should be less than the punishment for most other offenses.
