PP v. MUHAMAD ZAID ZAINAL [2013] 6 CLJ 121

[1] Issue: Whether the sentence of seven months’ jail imposed by the Magistrate on an accused for an offence under s. 447 read with s. 511 of the Penal Code (attempted criminal trespass) is ultra vires and illegal.

“As can be seen (from s. 447), the punishment for criminal trespass is imprisonment which may extend to six months, or with fine which may extend to RM3,000 or with both. (However), when s. 447 is read with (the phrase) “any term of imprisonment imposed shall not exceed one-half of the longest term provided for the offence” in s. 511, the imprisonment shall not be more than three months which is one-half of the six months. Thus, the maximum imprisonment term imposable for an offence of an attempted criminal trespass is one that may extend to three months and not six months as understood by the Magistrate. It is clear that, as from the date of his arrest, 6 November 2012 up to the date of his conviction and sentence by the Magistrate on 8 February 2013, the respondent had already served his sentence for a period of three months and two days, thus exceeding two days of his maximum sentence under ss. 447/511. Therefore, the imprisonment term of seven months imposed by the Magistrate in this case is not in accordance with the law and therefore illegal. It is ultra vires.” – per Zamani A Rahim J in PP v. Muhamad Zaid Zainal [2013] 6 CLJ 121.

‘REASONABLE MANAGEMENT ACTION’ OR ‘UNREASONABLE MANAGEMENT CONDUCT’?

In the language of Australian workers’ compensation legislation and other areas of workplace law, concepts such as “reasonable management action taken in a reasonable way” and “reasonable administrative action taken in a reasonable manner”[1] are commonly used to preclude liability for workplace injuries - including psychiatric or psychological disorders sustained in the course of employment - and, in practice, by employers to justify actions taken under the guise of merely “managing” workers within organisations.

Indeed, some managers may be of the view that “reasonable management action” is a catchall phrase which validates their every action in the workplace, no matter how unreasonable that action may, in fact, be when considered in light of all the prevailing circumstances.

UNDANG-UNDANG KELUARGA DAN TEKNOLOGI: SUATU PANDANGAN SEMULA*

PENGENALAN

Undang-undang Keluarga di Malaysia telah wujud secara tidak formal dalam masyarakat orang asli[1] lagi tetapi berkembang pesat dan dibuat secara bertulis semasa zaman Kesultanan Melayu Melaka. Ini dapat dilihat di dalam Kanun Melaka di mana terdapat bab atau peruntukan mengenai perkahwinan yang mana terdapat pengaruh adat dan Islam di dalamnya.[2] Semasa Tanah Melayu di jajah Portugis dan Belanda, undang-undang kekeluargaan bagi orang Melayu masih kekal mengikut undang-undang Islam. Orang China dan India berkahwin dan bercerai mengikut adat dan agama masing-masing. Hanya semasa penjajahan Inggeris, undang-undang keluarga Inggeris telah diperkenalkan di mana bukan sahaja seseorang boleh berkahwin mengikut undang-undang agama Kristian di gereja, pasangan juga boleh berkahwin di pejabat-pejabat pendaftar perkahwinan. Penjajah Inggeris telah memperkenalkan perkahwinan sekular, iaitu perkahwinan yang tidak melibatkan upacara keagamaan. Namun pihak Inggeris tidak memaksa semua orang menggunakan undang-undang mereka. Ia adalah suatu pilihan jika mahu.

Apabila Malaysia merdeka kedudukan Islam sebagai salah satu agama yang diperkukuh dengan menjadikannya agama Persekutuan melalui Perkara 3. Perlembagaan Persekutuan juga memperuntukkan bahawa Islam jatuh di bawah bidangkuasa Negeri. Dengan demikian semua urusan undang-undang kekeluargaan orang Islam dibuat, ditadbir dan dilaksanakan di setiap negeri. Namun bagi orang Islam, hal-hal kekeluargaan masih di bawah bidangkuasa kerajaan Persekutuan. Dengan demikian terdapat dua perundangan keluarga iaitu satu untuk orang Islam dan yang satu lagi untuk orang bukan Islam.
