SS LEGEND NAUTILUS (M) SDN BHD v. HAMZAH MOHD GHAUTH & ORS [2013] 3 CLJ 947

[4] Issue: Whether under the Customs Act 1967, the customs, upon seizing the plaintiff’s beer consignment and having received the plaintiff’s written claim for the consignment within one calendar month of the seizure, is duty bound to either release the said goods or refer the plaintiff’s claim to a Magistrate for a decision.

“I agree with learned counsel for the plaintiff that under s. 128(2) of the Customs Act 1967, where a person has asserted that he is the owner of such goods, he only needs to make a written claim before the expiration of one calendar month from the date of seizure of the goods. From the facts, the plaintiff had written a letter dated 17 July 2006 ... Thus, upon the expiration of one calendar month from the date of seizure, 10 July 2006, the defendants who had received the letter dated 17 July 2006 should have either released the said goods or refer the plaintiff’s claim to a Magistrate for a decision. Such failure by the defendants to refer the plaintiff’s claim to a Magistrate tantamount to a breach of the statutory duties pursuant to s. 128(1), (2) and (3) of the Customs Act 1967. As such based on the above reasons, the further detention of the beer consignment after one month from the date of its seizure without referring the matter to a Magistrate for a decision on the plaintiff’s claim was wrong in law. Thus, the answer to the second issue is in the affirmative” - per Suraya Othman J in SS Legend Nautilus (M) Sdn Bhd v. Hamzah Mohd Ghauth & Ors [2013] 3 CLJ 947.

LAUNCH OF THE ACT LAW SOCIETY FOUNDATION

This speech was given by the Hon Justice Patrick Keane of the High Court of Australia at the launch of the ACT Law Society Foundation on Wednesday 29 May.

The Foundation is a Centenary of Canberra project established as a charitable fund to support Canberra’s charities and other worthy causes.

It is a great honour to be asked to launch the ACT Law Society Foundation this evening.

For 80 years the Law Society of the ACT has often been the first port of call for people with a legal problem. For 43 of those 80 years it has exercised statutory control over the professional conduct of lawyers in the Territory.

The Society has always been taken seriously its vital role in the administration of justice in the ACT. It has dealt sympathetically with the many phone calls it has received from Canberrans anxious about their legal rights and responsibilities.

WHO DECIDES VALIDITY OF ARBITRATION AGREEMENT - COURT OR ARBITRAL TRIBUNAL?

1. Abstract

An arbitration agreement, usually in the form of an arbitration clause within a master agreement, has the effect of binding the parties to submit disputes between them to arbitration. However an interesting question arises as to who decides the validity of the arbitration agreement when the same is disputed. There are two logics here. The first is that when the validity of the arbitration agreement itself is disputed, the jurisdiction of the arbitral tribunal is in question and accordingly it is ideal that the court determines the issue. The second is that the issue of validity of the arbitration agreement might be raised only when the matter is already before the arbitral tribunal. It may place the process of arbitration in a difficult position if the arbitral tribunal is obliged to suspend the case before them upon any dispute being raised as to the validity of the arbitration agreement.

To some extent there is legislative intervention in this matter that helps resolve this dilemma. This article aims to examine this question, that is, who determines the validity of an arbitration agreement. The answer may vary depending on when and where the issue is raised.
