Penal Code, 1860 - S. 292 - Obscenity - What constitutes - Test for determination of obscenity - Community standard test applicable - Hicklin, (1868) LR 3 QB 360, test not the correct test - Obscenity, held, should be determined from point of view of average person and in context of contemporary mores and national standards, as concept of obscenity keeps on changing with changing social values - Message which offending object intended to convey is significant - Photograph of a nude/semi-nude woman by itself cannot be obscene - Obscenity would depend upon particular posture and background in which nude woman is depicted - Looked at as a whole, it should tend to deprave and corrupt the mind and excite lustful sexual passion so as to constitute offence under S. 292 - Publication in newspaper of picture of a nude white-skinned man (renowned German tennis player) standing close to his dark-skinned nude/semi-nude fiancée (actress) and man covering breast of fiancée with his hands, followed by an article conveying message to people against practice of apartheid/racism and that love triumphs over hatred - Held, photograph not obscene - Hence no offence committed under S. 292 - Magistrate erred in initiating proceedings under S. 292 IPC and S. 4 of Indecent Representation of Women (Prohibition) Act without proper application of mind - High Court also erred in refusing to quash the proceedings in exercise of power under S. 482 CrPC - Proceedings quashed - Criminal Procedure Code, 1973 - S. 482 - Crimes Against Women and Children - Indecent Representation of Women (Prohibition) Act, 1986 - S. 4 - Constitution of India, Arts. 19(1)(a) & (2)

IN THIS ARTICLE, SIM SOOK ENG CONSIDERS THE EFFECTIVENESS OF BOTH INDUSTRIAL DESIGN PROTECTION AND COPYRIGHT PROTECTION FOR FASHION DESIGNS.

The fashion industry

Fashion designs are highly valuable assets as designers have expended much creative effort and resources in their creation. Although there is rampant copying and derivative reworking by appropriation of fashion designs, little action is seen taken against those who copy the designs of others. As a safeguard, trade mark protection seems to be the preferred choice of protection for brands in the fashion industry. However, despite the copying, the fashion industry continues to grow. Creative and innovative ideas continue to flourish to develop new prestigious design trends, and investments in the fashion industry continue to be dynamic. Certain fashion designs having a short product life cycle might also be a reason for inaction. However, as there are still classic fashion designs that do not go out of fashion, the question is to what extent these and the new fashion designs are protected by the intellectual property laws of Malaysia.

PENGENALAN

Kertas ini dikemukakan bagi menjelaskan kepentingan memahami hubungan antara prinsip maqsad hifz al-mal, prinsip al-wasail dan kaitannya dengan sebahagian usaha umat Islam di Malaysia mengeksperimenkan sebuah pembangunan sektor perbankan berteraskan Syariah. Maqsad hifz al-mal sebagai salah satu elemen fundamental yang membentuk kerangka besar maqasid al-Syariah sebenarnya memainkan peranan yang penting dalam membentuk idealisme dan citra unggul acuan untuk mencorakkan pembentukan, pengembangan serta pengukuhan sektor perbankan Islam di negara ini. Maqasid hifz al-mal, sebagai suatu kerangka falsafah dan objektif hukum memerlukan mekanisme penggerak dan landasan operasi dalam alam realiti bagi direalisasikan dan mekanisme ini dalam disiplin fiqh al-maqasid dikenali sebagai al-wasail. Justeru, tidak dapat tidak, perbincangan tentang realisasi maqasid hifz al-mal perlu melibatkan perbincangan tentang konsep al-wasail.

Secara yang lebih lanjut, ditinjau dari perspektif fiqh al-maqasid-al-wasa'il, perkembangan industri perbankan dan kewangan Islam negara ini, selain daripada melihatnya dari segi respons praktikal umat Melayu-Islam serta pemenuhan secara kolektif terhadap tuntutan khitab Ilahi berkenaan dengan pengurusan aspek kehartaan dan kewangan, ia juga boleh dilihat sebagai upaya umat dalam mewujudkan wahana penghubung atau pelengkap yang diistilahkan dalam disiplin maqasid disebut sebagai wasa'il dan sub-wasa'il tertentu bagi mencapai tuntutan maqsad hifz al-mal. Penulisan ini diketengahkan dalam rangka perbincangan wasa'il berkenaan; dengan fokus diberikan kepada penggunaan teknologi tertentu yang berstatus wasilah kepada usaha pemantapan dan pengukuhan tahap kompetensi dan prestasi industri perbankan Islam.
