COSTS MANAGEMENT: A NECESSARY PART OF THE MANAGEMENT OF LITIGATION SIXTEENTH LECTURE IN THE IMPLEMENTATION PROGRAMME

Introduction

1. In Sir Rupert Jackson's Final Report he identified the need for the court to take on the important role of costs management as a necessary part of case management. It is no longer acceptable for questions of costs to be left to the end of litigation when the costs have been spent. Some control on the expenditure of costs needs to be implemented as part of the case management of cases. That control will now be provided by costs management which is being introduced by rules changes as part of the implementation of the recommendations in the Final Report.

The Recommendations in the Final Report

2. The Final Report[1] referred to six propositions which were set out in the Preliminary Report[2] and agreed, in principle, in the Law Society's written submission[3]. Those are:

(i) Litigation is in many instances a "project", which both parties are pursuing for purely commercial ends.

(ii) Any normal project costing thousands (or indeed millions) of pounds would be run on a budget. Litigation should be no different.

(iii) The peculiarity of litigation is that at the time when costs are being run up, no-one knows who will be paying the bill. There is sometimes the feeling that the more one spends, the more likely it is that the other side will end up paying the bill. This gives rise to a sort of "arms race".

PERKONGSIAN FAIL DAN PERKONGSIAN LAMAN DALAM PERMASALAHAN PELANGGARAN HAK CIPTA DAN KEBEBASAN BERSUARA

Pengenalan

Kemudahan Internet telah membuka ruang kepada pengguna untuk berkongsi fail. Aktiviti perkongsian fail dan perkongsian laman melibatkan bahan-bahan kandungan yang dilindungi oleh undang-undang hak cipta. Perkongsian fail teknologi digital ini telah memberi masyarakat peluang persekitaran yang lebih menyeluruh untuk kebebasan bersuara disamping pertukaran maklumat yang lebih murah dan cara yang lebih berkesan untuk sebarkan pengetahuan.[1] Walau bagaimanapun, pelakuan ini adakalanya dilakukan tanpa mendapat izin terlebih dahulu daripada pemunya hak cipta. Dalam erti kata lain, prinsip kebebasan bersuara telah disalah gunakan. Perkongsian fail merujuk kepada aktiviti muat turun dan muat naik karya hak cipta seperti menerusi penggunaan sistem peer-to-peer (P2P) yang mudah diperolehi menerusi Internet seperti aplikasi perkongsian muzik seperti Napster. Rangkaian P2P melibatkan pemindahan data dari satu pengguna kepada pengguna yang lain tanpa menggunakan pelayan pengantara. Manakala perkongsian laman pula melihat kepada masalah-masalah hak cipta menerusi aplikasi-aplikasi yang berlaku di laman-laman sesawang menerusi komputer peribadi, tablet, telefon pintar dan pelbagai peralatan komunikasi terkini. Artikel ini akan menjelaskan perkaitan di antara (i) perkongsian fail dan hak cipta serta (ii) perkongsian laman dan hak cipta. Selain itu, isu utama kepada tujuan penulisan artikel ini dapat dilihat menerusi perbincangan dalam bahagian (iii) pelanggaran hak cipta di Internet dan kebebasan bersuara dan (iv) mekanisme penyelesaian permasalahan hak cipta di Internet dan kebebasan bersuara.

(i) Perkongsian Fail dan Hak Cipta

Perkongsian fail yang menggunakan teknologi P2P mencetuskan fenomena dalam dunia Internet. Kehadiran teknologi rangkaian P2P ini membolehkan pengguna seluruh dunia bertukar fail digital, justeru ia meningkatkan konflik di antara pemunya hak cipta dan pengguna di ruang siber.[2] Teknologi P2P telah menimbulkan suasana yang mengancam dan panik.[3] Rangkaian P2P beroperasi tanpa sistem berpusat tetapi sebaliknya data diedarkan di antara beberapa rakan-rakan yang beroperasi pada rangkaian yang sama. P2P secara kebiasaannya beroperasi dengan membenarkan pengguna untuk memuat turun perisian yang boleh didapati secara percuma.[4] P2P merupakan salah satu rangkaian yang mengecewakan imbangan kawalan secara tradisional terhadap penciptaan, pengeluaran semula, pengedaran serta penggunaan pengetahuan dan maklumat.[5] Perkongsian fail secara haram adalah bersalahan di bawah undang-undang hak cipta. Aktiviti tersebut terjumlah kepada kesalahan pemintasan langkah-langkah perlindungan teknologi (TPM). Terdapat pelbagai jenis rangkaian perkongsian fail P2P seperti rangkaian penghantaran kandungan seperti Ignite dan RedSwoosh. Selain itu, rangkaian perkhidmatan kandungan atau P2P caching seperti Corelli Caches pula merupakan teknologi pengurusan rangkaian komputer yang digunakan oleh Pemberi Perkhidmatan Internet (ISP) bagi mempercepatkan penghantaran kandungan serta mengurangkan kos jalur lebar manakala perisian penerbitan dan pengedaran pula berfungsi menerusi rangkaian perkongsian fail seperti Linux.
