LEGAL AND INSTITUTIONAL FRAMEWORK FOR PERSONS WITH DISABILITIES IN MALAYSIA

ABSTRACT

This paper intends to have an overview of the law and institutions that relates to people with disabilities (PWDs) in Malaysia. The issue is basically focussing on the aspect of employment, one of the difficulties faced by PWDs worldwide. Under the legal framework, the discussion is mainly based on the selected provisions in the legislation, namely the Persons With Disabilities Act 2008 (PWDA) which is the cornerstone for the legal recognition of the rights of PWDs in Malaysia. As for the institutional framework, the agencies dealing with PWDs are highlighted. It is submitted that the legal and institutional framework for PWDs in Malaysia is good enough in acknowledging their rights. Having said this however, a few aspects still need to be given attention namely; the effective implementation of the law and functioning of the agencies for the better enhancement of PWDs in Malaysia.

INTRODUCTION

The United Nations has estimated the number of persons with disabilities (PWDs) as 10% of the world population with 80% of them is living in developing countries (United Nations Enable, 2007). The World Health Organization (WHO) and World Bank (2011) further predicted about 15 percent of the world population have some form of disabilities. In Malaysia, the statistics in 2013 showed the number to be nearly 500,000 (Department of Social Welfare Malaysia, 2014). This number however, are PWDs who have registered with the Department of Social Welfare Malaysia. Taking this world estimation into consideration, the number of PWDs in Malaysia is believed to be far from those statistics.

The fact about PWDs is, among others, unemployment. The International Labor Organization (ILO) estimated 386 million of the world's working-age people have some kind of disability with an unemployment rate as high as 80 percent in some countries (Disabled World, 2013). In Malaysia, the Department of Social Welfare Malaysia (2009) reported that, since 1990 until 2007, 8,117 PWDs had successfully been placed in the private sector. The recent statistics further showed 1,754 PWDs are located in the public sector (Berita Harian, October 1, 2013). This number is obvious evidence of the low employment rate of PWDs, particularly when compared to the number of registered PWDs in Malaysia. The US Bureau of Labor Statistics (2013) reported about 80 percent of all persons with a disability who were not working admitted that their own disability was a barrier to employment.

KEPERLUAN UNDANG-UNDANG DALAM PERKEMBANGAN PENGAMALAN TEKNIK REPRODUKTIF BERBANTU (TRB)*

PENGENALAN

Ketidaksuburan atau infertiliti merupakan masalah global yang kini semakin diberi perhatian sejajar dengan perkembangan bioteknologi. Organisasi Kesihatan Dunia (World Health Organisation, WHO) melaporkan yang lebih 80 juta individu dalam masyarakat dunia kini menghadapi masalah infertiliti dan ini tidak terkecuali Malaysia.[1]

Masalah infertiliti sering dikaitkan dengan penggunaan teknik reproduktif berbantu (TRB) atau assisted reproductive technologies. Semenjak kelahiran Louise Brown menggunakan teknik persenyawaan in vitro (IVF) hampir 30 tahun lalu, masyarakat umumnya telah didedahkan kepada teknologi yang membolehkan seseorang mendapatkan anak tanpa perlu melalui hubungan seksual atau persetubuhan.

TRS boleh didefinisikan sebagai sebarang rawatan atau prosedur yang melibatkan pengurusan atau perlakuan terhadap gamet[2] manusia di luar tubuh badan untuk tujuan mendapatkan anak. Termasuk di dalam TRB ini adalah teknik persenyawaan in vitro (IVF), suntikan sperma dalam sitoplasma (ICSI), perpindahan gamet intra fallophian (GIFT), embriologi, pembekuan embrio/sperma (Cryopreservation), permanian dalam rahim (IUI), pendermaan sperma dan ovum dan juga pendermaan embrio. Selain daripada mengatasi masalah kegagalan mendapatkan anak, melalui proses diagnosa genetik pra-penempelan (pre-implantation genetic diagnosis) atau PGD, TRB juga digunakan untuk mengesan keabnormalan genetik pada embrio seperti kemungkinan menghidapi sindrom down (down syndrome) atau talasemia. Ada pasangan menggunakan teknik ini untuk memilih gender anak mereka. Fenomena ini yang dipanggil pemilihan gender atau sex selection sering diperdebatkan di peringkat antarabangsa kerana perkaitannya antara lain dengan permasalah eugenik (eugenic)[3] dan perkaitannya dengan soal agama dan etika. Penggunaan TRB dalam permasalahan infertiliti akan melalui proses pengambilan dan persediaan gamet dari tubuh badan manusia, persenyawaan, perpindahan embrio atau embrio berganda (multiple embryo) ke dalam rahim wanita, kehamilan dan seterusnya kelahiran (Bioethics: 2004).
