ANG SUE MEH v. JASHEN INTERIOR DESIGN SDN BHD Abstract – (i) An employer commits a repudiatory breach of contract when it unilaterally assigns an employee to duties entirely unrelated to, and incompatible with, their original job description. This is particularly true where the employee lacks the technical training or engineering background required for the new role, evidencing an intention by the employer no longer to be bound by the contract; (ii) The unilateral reduction of an employee’s salary without consent, due process, or bona fide justification constitutes a fundamental breach. Salary deductions framed as assistance without a structured performance improvement plan (PIP) or clear targets are deemed arbitrary penalties. TAN JING SHYUAN v. BP DIAGNOSTIC CENTRE SDN BHD Abstract – The determination of whether a professional engagement is a contract of service or a contract for services depends on the substance of the arrangement over its form. A relationship may constitute a contract for services, even where some degree of administrative control exists. |
