Abstract – An Industrial Court’s jurisdiction to determine whether a dismissal was with just cause or excuse is not ousted merely because an employee subsequently abandons or ceases to seek the remedy of reinstatement during trial. Abandoning a prayer for reinstatement does not disentitle the claimant from seeking other statutory remedies, such as compensation in lieu of reinstatement and backwages.
